1) About Us

Elegância Brazilian Salon (“we”, “us”, “our”) operates https://eleganciabs.com (the “Site”) and provides in-salon beauty services for ladies only in Bnaid AlGar, Kuwait City, Kuwait.

These Terms govern your use of the Site and our booking, lead forms, and services. By using the Site or booking with us, you agree to these Terms. If you do not agree, please do not use the Site or submit information.

2) Eligibility

Our services are for ladies aged 13+. Clients under 18 must be accompanied by a guardian. We may decline or discontinue services for safety, hygiene, or policy reasons.

3) Appointments, Deposits & Cancellations

  • Booking & deposits: To secure an appointment or stylist, a deposit or prepayment may be required and applied to your service bill.

  • Rescheduling: You may reschedule once without penalty if you notify us ≥24 hours before your appointment.

  • Late cancellations/no-shows: Cancelling <24 hours or not attending may result in deposit forfeiture. Repeated no-shows may require full prepayment for future bookings.

  • Arrival & lateness: Please arrive on time. Arrivals 15+ minutes late may be shortened or rebooked; fees or deposit rules may apply.

  • Salon rescheduling: If we must change your appointment, we’ll offer priority rebooking or return your deposit upon request.

4) Consultations, Service Limits & Aftercare

  • Consultation: Final results depend on your hair’s condition and history. We may recommend patch tests (e.g., color) 24–48 hours prior.

  • Limits: Prior henna/box dye, chemical history, or breakage can limit achievable results or require multiple sessions (especially for color corrections).

  • Aftercare: You’re responsible for following the aftercare we provide (e.g., professional sulfate-free care, heat protection, timing after nano/keratin). Outcomes may degrade if guidance is not followed.

  • No medical advice: Our recommendations are cosmetic, not medical.

5) Redo (Adjustment), Refunds & Returns

Our goal is an outcome consistent with the agreed plan and your hair condition. If you have concerns:

  • Contact us within 7 days for an in-person assessment with the same or a senior stylist.

  • If we confirm a deviation from the agreed plan caused by our application, we may offer a complimentary adjustment. Where not practical, a partial refund or service credit may be offered at management’s discretion.

  • Change of preference, non-compliant aftercare, or concerns raised after 7 days are not eligible for a complimentary redo.

Retail products: Unopened items may be refunded/exchanged within 7 days with receipt; opened items are non-returnable for hygiene, unless defective. Manufacturer warranties apply to electricals.

6) Quotes, Pricing & Payment

  • Estimates: Quotes are estimates based on consultation and may change with hair condition, additional product/time, or technique changes.

  • Pricing: We may update pricing and promotions at any time.

  • Payment: Pay using accepted methods at the salon or online (where available). Taxes/fees may apply. Refunds (when approved) go to the original payment method; banks control posting times (typically 7–14 business days).

7) Packages, Promotions & Gift Cards

  • Packages: Unused packages refundable within 7 days. Partially used packages refundable as store credit only, calculated pro-rata minus used sessions at standard (non-package) rates.

  • Promotions/complimentary items: Non-refundable and may have specific terms; complimentary add-ons carry no cash value.

  • Gift cards: Non-refundable, not redeemable for cash; transferability at management’s discretion.

8) Lead Forms, WhatsApp & Communications

When you submit Meta/website lead forms or contact us via WhatsApp/phone/email/social, you consent to being contacted about consultations, pricing, and bookings. You may opt out of marketing at any time (e.g., reply STOP on WhatsApp).

9) Content & Photo Consent

We may request before/after photos to track work quality. We will only use identifiable images for marketing with your explicit written consent. You can withdraw consent for future use at any time (does not affect prior lawful use).

10) Website Use & Intellectual Property

  • License: We grant you a limited, non-transferable license to access and use the Site for personal, non-commercial purposes.

  • Prohibited: Scraping, reverse-engineering, interfering with Site operation, unauthorized data collection, infringing IP, or illegal use.

  • IP ownership: All content (text, logos, photos, designs) is owned by us or our licensors. Do not reproduce without prior written permission.

  • Third-party links: External sites are not under our control; we’re not responsible for their content or policies.

11) Privacy & Cookies

Your privacy matters to us. Our Privacy Policy explains what we collect, how we use it (including Meta Pixel/Analytics), and your choices. By using the Site or submitting leads, you agree to our Privacy Policy.

12) Disclaimers

  • Services are provided with reasonable skill and care consistent with professional salon practice. However, individual results vary due to hair history, condition, and aftercare.

  • The Site is provided “as is” and “as available”. We do not warrant uninterrupted or error-free operation.

  • Nothing in these Terms limits any non-waivable rights under applicable law.

13) Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages, lost profits, or loss of data arising from your use of the Site or services. Our total liability for any claim related to services is limited to the amount you paid for the specific service giving rise to the claim, without prejudice to mandatory laws in Kuwait.

14) Indemnity

You agree to indemnify and hold us harmless from claims or liabilities arising from: (a) your breach of these Terms; (b) your misuse of the Site or services; (c) content you submit; or (d) violation of laws or third-party rights.

15) Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., government actions, outages, extreme weather, supply constraints).

16) Governing Law & Disputes

These Terms are governed by the laws of the State of Kuwait. Disputes will first be addressed amicably by contacting admin@eleganciabs.com. If unresolved, disputes are subject to the competent courts in Kuwait.

17) Changes to These Terms

We may update these Terms periodically. The “Effective date” shows the latest revision. Continued use of the Site or services after updates constitutes acceptance.
